Wight Event Toilets - Terms & Conditions 

Definitions:
*All business is conducted in accordance with these Conditions of Hire, unless otherwise amended in writing by the company.

*The "Company" means Wight Event Toilets Ltd & WET.

*The "Hirer" means the person, persons or their representative hiring the "Equipment" from the "Company".

*The "Equipment" means mobile toilet unit and equipment including all fixtures and fittings.

Terms of Hire
*All orders are accepted by us subject to these Terms and Conditions of Hire, and the information in our Quotation and Booking Form.

*We are not bound by any variation unless it is in writing and signed by a director.

Quotations
All quotations are subject to the availability of Equipment. Whilst every effort will be made to ensure that the Equipment ordered is delivered we reserve the right to substitute the nearest available item should the specific Equipment be unavailable.

Site/ Ground/ Location
*The hire charges are based on the assumption that the ground is flat, level and solid with suitable access for the “Equipment” and associated motor vehicles(s).

*The Hirer warrants that the vehicles and Equipment belonging to the Company will have suitable access free from all overhead obstructions, trees, hedges etc and without buried pipes or other concealed services that may suffer damage occasioned by the transport, use erection/installation and/or dismantling/removal of the Equipment.

*If the site conditions/ access are not as agreed with The Company then The Company reserves the right to charge for any damage that may have occurred to vehicles or equipment.

*The Company reserves the right to charge accordingly for delays and additional labour time required in connection with works/delivery/collection and time spent due to the unsuitable site conditions and/or soft ground due to inclement weather, or any other condition. One hour maximum site time is allowed for delivery and collection of the units.

*The Company will not be responsible for any making good or repair of damage to the site howsoever caused.

*The hirer will always be responsible for providing any connections or access to mains services (water, power, drainage) if necessary. Appropriate services and requirements shall be agreed prior to arrival.

*The Company will not be liable for any spillages onsite. All equipment provided is self- contained.

*If collection of the Equipment is delayed beyond the recorded date for any reason (marquee restricting access, inclement weather) The Company reserves the right to charge for additional hire at the rate of 20% per day of the quoted daily hire charge, or a full rental rate if a subsequent order cannot be fulfilled, due to the non-availability of the unit (which ever being appropriate).

Liability
*The Equipment shall at all times remain the property of Wight Event Toilets LTD, and the Hirer shall have no right, title or interest in or to the Equipment.

*Wight Event Toilets Ltd have all units insured against public & employee liability for the equipment hired. We would require the Hirer to make sure the units are insured with an all risk policy against loss, damage & theft during the hire period.

*The risk of loss, theft, damage or destruction of the Equipment shall pass to the Hirer on Delivery. The Equipment shall remain at the sole risk of the Hirer during the Rental Period and any further term during which the Equipment is in the possession, custody or control of the Hirer until such time as the Equipment is collected by Wight Event Toilets LTD during the Rental Period.

*When the Hirer is obtaining Insurance for the Equipment they are hiring, this must be to a value not less than its full replacement value comprehensively against all usual risks of loss, damage or destruction by fire, theft or accident, and such other risks as Wight Event Toilets may from time to time nominate in writing.

*The Hirer must give immediate written notice to Wight Event Toilets LTD in the event of any loss, accident or damage to the Equipment arising out of or in connection with the Hirer's possession or use of the Equipment.

*The Hirer shall remain liable to pay the Rental Payment for the Equipment up to and including the date it notifies Wight Event Toilets LTD that the Equipment have been lost, stolen and/or damaged beyond economic repair.
 
*The Company accepts no liability whatsoever in respect of third party claims or for consequential loss or damage of any kind and the Hirer shall indemnify the Company against third party claims unless such liability be caused by faulty materials, workmanship or negligence on the part of the Company.

*The Company accepts no liability whatsoever in respect of any malfunction of the Equipment provided during the agreed hire period if user numbers exceed the guidelines set by The Company in the quotation. The hirer will be liable for any repairs/ damages/ malfunctions caused because of this.

*The Company accepts no liability whatsoever in respect of any malfunction of the equipment due to weather conditions – such conditions may be, but are not limited to, very hot or cold weather, flooding, snowing etc.

Title
*The Equipment and accessories remain the property of The Company at all times. The Hirer will allow the Company reasonable access to the Equipment during the hire period at all times. If The Company is not happy with the hirer’s actions the equipment can be withdrawn from the event at any chosen time.

*The Hirer shall keep the Equipment in his/her own possession and control, and free from all legal processes and undertakes that no mortgage deed, bill of sale or any other legal instrument or private arrangement whatsoever shall be exercised whereby other person, lien or company other than the Company shall acquire any lien or rights whatsoever in connection with the Equipment.

Subletting
*The Hirer will not sublet or rehire the Equipment at anytime without a written agreement
which has been approved and signed by The Company.

Delivery/ Collection
*If the Hirer has chosen to position the equipment in a specific location then an authorised representative must be available at the agreed delivery time to instruct The Company where to post

*Where the Hirer has agreed to position the Equipment in a specific location, the Hirer must have an authorised representative available at the time of delivery to instruct the Company of its designated location. If access to the equipment during delivery or collection is restricted due to event security gates or designated staff, an authorised representative must gain The Company access to the equipment.

*The Hirer will pay extra for any further time or attendance including any attempt by the Company to carry out delivery, collection or servicing which is unsuccessful or delayed due to the Hirer’s acts or omissions.

The Equipment
*The Hirer shall indemnify the Company and be responsible for all expenses involved arising from any breakdown, wilful damage and any loss incurred by the Company due to negligence loss and/or misuse of the Equipment by the Hirer or persons using the Equipment on a time and replacement cost basis currently in use by the Company at the time.

*No smoking is allowed in the Equipment whatsoever. It is the Hirer’s responsibility to ensure that their guests comply with this requirement at all times.

*No candles are to be used in or near the Equipment at anytime.

If any damage (excluding reasonable wear and tear resulting from reasonable use) is caused to the floor of the Equipment the Hirer shall be liable to pay the Company a fee of £700.00 to cover repairing the damage done. Such damage may include but is not limited to cigarette burns caused by smoking in the Equipment, damage caused by guests wearing unsuitable footwear (for example golf spikes or football boots), chemical spills which may stain or split the flooring.

*The Hirer shall not move the Equipment from the site or position it was delivered or consigned to without a written agreement and signature by The Company.

 *The Equipment must be returned to the Company in the same condition as it was when it was delivered to the Hirer (except for reasonable wear and tear resulting from reasonable use). Failure to leave the Equipment in an acceptable condition once returned to The Company will result in an additional cleaning fee of £120.00, which must be paid by the Hirer direct to The Company.

Additional Charges
Extra charges may apply in the event of the following:

*Additional vehicles required to site or remove in adverse conditions. 
*Equipment inaccessible.
*Waste emptying if required.
*Equipment returned in unhygienic conditions. 
*Callout charges may apply in event of a breakdown.
*No brand stickers, drawing pins, sellotape, graffiti etc. on or into the fabric of the cabin/trailer.
*Any damage caused to equipment.
*Items removed from units and not returned, bins etc.
*No naked flames, candles etc. in units.
*Keys not returned will be charged at £20per key.
*All Congestion and Emission Zone charges will be invoiced where applicable.
*Excessive waiting time on site.
*Fuel surcharges may apply.


Hire Charges and Payment

*The hire charge, delivery and collection for the Equipment are as specified in the Quotation.

*The period of hire and maximum numbers utilising the Equipment is as stated in the Quotation.

*Bookings are only accepted and confirmed on receipt of a 25% deposit (“the Deposit”).

*In the event of cancellation for any reason whatsoever the Company reserves the right to levy cancellation charges as follows:
1-8 months: forfeit 100% of the Deposit 
Event date to 1 month: forfeit up to 100% of the total quoted Price at the discretion of the Company. 

*If you have chosen to postpone your booking and Wight Event Toilets has moved your deposit payment onto a new date (subject to availability) and you then wish to cancel your booking at a later date then your deposit payment will not be refunded by the company.

*Final delivery of the unit is subject to full payment of all hire costs (7) seven days before delivery. 

*Overdue accounts are subject to a 10% surcharge per month. 

*Acceptance of the Equipment on site by the Hirer shall in itself constitute acceptance in full of the above terms and conditions supplied by The Company.
